TERMS OF SALE

  1. PAYMENT: Payment in full shall be made at time of Purchase.  On Special Orders or Delivery Products, a minimum 100% of the Purchase Price is to be paid by the Customer at the time of Purchase. InsideOut Patio does not accept payment over the phone.
  2. RETURN POLICY: All sales of Products are final sale.  No refunds or returns of Products will be accepted.  InsideOut Patio will at its sole discretion allow for the exchange of Products or a store credit on the following conditions: (i) the Products are returned within 7 days of the date of purchase; (ii) the Products are in their original condition and packaging; (iii) the Products are not a special order; (iv) the Products are not floor models; (v) the Products have not been used; (vi) the Customer shall pay a 5% restocking fee; and (vii) the store manager upon inspection of the Products approves the return of the Products.  For Products that are delivered, the Customer shall at its sole cost pay the delivery cost of returning the Products.
  3. SPECIAL ORDERS: InsideOut Patio does not guarantee the timing of delivery of Special Order Products.  The Customer accepts that Special Orders may take longer than anticipated at the time of Purchase and InsideOut Patio is not responsible for any delays in delivery of Special Orders that are beyond the control of InsideOut Patio.  All Special Orders are final sale.
  4. DELIVERY: Delivery of Products will be scheduled between 10 am and 8 pm Monday to Saturday.  Delivery times are subject to change and InsideOut Patio will make best effort to get Products delivered within the time frame provided but the time frame provided is a best efforts time frame and not a guarantee of delivery time. The Customer shall ensure that someone is available to receive the Products at the time of the Delivery. The Products must be inspected at time of Delivery and any issues must be identified at that time failing which the Purchaser is deemed to have accepted the Products as is.  
  5. WARRANTIES: All warranties are manufacturer warranties that come with the specific Product(s) purchased by the Customer.  InsideOut Patio makes no representations with respect to the manufacturer warranties.  Manufacturer Warranties do not cover damages caused by, but not limited to, acts of nature, animal damage, insect damage, wind damage and normal wear and tear of product, including but not limited to fading, chipping and scratching.
  6. FORCE MAJEURE:  In addition to the other terms and conditions set out herein, any delay or non-performance of any obligation herein by InsideOut Patio shall be excused if the cause of the delay is a Force Majeure Event.  A Force Majeure Event is defined as an event that is beyond the reasonable control of InsideOut Patio seeking to be excused from performance, is not attributable to such party’s negligence, and could not have been avoided or overcome and includes, but is not limited to the following, acts of God, actions by any governmental authority (whether valid or invalid), fires, floods, windstorms, explosions, riots, natural disasters, pandemics or epidemics and acts of terrorism, sabotage or war. 
  7. LIMITATION OF LIABILITY:  The Customer agrees that InsideOut Patio makes no express or implied representations, warranties or conditions, concerning the merchantability, fitness for purpose of the Products, or correspondence with description of the Products shall be binding on InsideOut Patio.  The Customer hereby agrees at time of Purchase to assume all liability for all injury and damages directly or indirectly caused by the Product(s) or its/their use.  Without limiting the generality of the foregoing, InsideOut Patio will not be liable for any indirect, special, incidental, punitive or consequential damages or expenses, including loss of use of any Products or inconvenience, economic or commercial loss, personal injury or death sustained in connection with the Product(s) purchased by the Customer even if any such damages or expenses were reasonably foreseeable.
